In this Privacy Policy (“statement”), we, Kansys Inc, provide information about how we collect, use, disclose, and transfer personal information from you, an individual person and website visitor, through Kansys’ publicly accessible websites.
This statement outlines our general policy and practices for implementing the Principles, including the types of information we gather, how we use it and the notice and choice affected individuals have regarding our use of and their ability to correct that information.
This statement applies to all personal information collected or received by the Company through our website and the Kansys billing platform(s).
Collected Data & Data Usage:
The Kansys billing system’s collect information under the direction of our Clients and has no direct relationship with the individuals whose personal data it processes. If you are a customer of one of our Clients and would no longer like to be contacted by one of our Clients that use our service, please contact
the Client that you interact with directly. We may transfer personal information to companies that help us provide our service. Transfers to subsequent third parties are covered by the service agreements with our
Clients.
An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct his query to the Client (the data controller). If requested to remove data, we will respond within a reasonable timeframe.
We will retain personal data we process on behalf of our Clients for as long as needed to provide services to our Client. We will retain this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
Sharing of Collected Data:
Data Subjects have the right to opt out of (a) disclosures of their personal information to third parties not identified at the time of collection or subsequently authorized and (b) uses of personal information for purposes materially different from those disclosed at the time of collection or subsequently authorized. Data Subjects who wish to limit the use or disclosure of their personal information should submit a request to dataprivacy@kansys.com.
Data Privacy Framework:
Kansys complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Kansys has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union and the United Kingdom in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF. Kansys has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Cookies:
When you interact with the Kansys website or software service, we may use cookies to help make your experiences easy and meaningful. “Cookies” are a technology employed by many other websites and are small data files stored on your computer. Cookies cannot be used to run programs or deliver viruses to
your computer.
Standing alone, cookies do not identify you personally. They merely recognize your browser. Unless you choose to identify yourself to Kansys, either by responding to a promotional offer, completing a contact or interest form or registering for an account, you remain anonymous to Kansys.
Third-Party Sites:
Our websites may contain links to enable you to visit other websites of interest easily. However, once you have used these links to leave our site, you should note that we do not have any control over the linked website. Therefore, we cannot be responsible for the protection and privacy of any information
which you provide while visiting such sites.
Such sites are not governed by this privacy statement and may or may not be compliant with privacy laws. You should exercise caution and look at the privacy statement, if available, of the website in question.
Correcting & Updating Data:
Kansys is dedicated to maintaining accurate and up to date Customer Data. If you need to update Data and/or billing information or to have your information deleted please email dataprivacy@kansys.com. Kansys will respond to your correction or update request within 30 days from the date of your request.
Security & Breach Notification:
Kansys has placed commercially reasonable security measures in place to protect the integrity, availability, and confidentiality of Data. These measures include policies, procedures, employee training, and physical access and logical security controls. In addition, when accessing the Kansys software systems, Data transmitted to Kansys’ servers are secured using standard security protocols and mechanisms such as SSL encryption to ensure data confidentiality and integrity.
If individual personal Data is acquired, or is reasonably believed to have been acquired, by an unauthorized person and applicable law requires notification of affected individuals, Kansys will issue a notification
of the breach by email or fax or, if Kansys is unable to contact the individual by these means, then by U.S. mail. Notice will also be sent to Customers when a breach affects Customer-provided Data, and to legal and law enforcement authorities as required under current laws and regulations. Any measures necessary for Kansys or legal and law enforcement to determine the scope of the breach and to assure or restore the integrity of the data system will be taken. Kansys may delay notification to Customers and/or individuals if Kansys or a law enforcement agency determines that the notification will impede a criminal investigation, unless and until Kansys or the agency determines that notification no longer compromises an investigation.
Controlling your personal information on our websites

You may request details of personal information which we hold about you under the Data Protection Act, 1998. If you would like a copy of the information held on you, please write to the address above. A small fee may be payable.
If you believe that any information we are holding on you is incorrect or incomplete, please write to or email us as soon as possible, using the contact information provided above. We will promptly correct any information found to be incorrect.
Accountability for Onward Transfers
Kansys transfers Personal Data to a third party, acting as a Controller, in conformance with the Principals of Notice and Choice. Kansys will enter into a contract with any third-party controller which will provide that:
- Such Personal Data may only be processed for limited and specified purposes consistent with the consent provided by the Data Subject;
- The recipient third party will provide the same level of protection as the level of protection afforded in the Principles; and
- The recipient third party will notify Kansys if it determines it can no longer meet this obligation and will subsequently cease processing or take other reasonable and appropriate steps to remediate its perceived deficiencies.
Kansys will only transfer personal data to a third party acting as KANSYS’ agent if:
- Kansys’ Personal Data transfer to the third party agent is only for limited and specified purposes;
- Kansys ascertains that the agent is obligated to provide at least the same level of privacy protection as is required by the Principles;
- Kansys takes reasonable and appropriate steps to ensure that the third party agent effectively processes the Personal Data transferred in a manner consistent with Kansys’ obligations under the Principles;
- Kansys requires that the third party agent notify Kansys if it determines that it can no longer meet its obligation to provide the same level of protection as is required by the Principles and will subsequently cease processing or take other reasonable and appropriate steps to remediate its perceived deficiencies; and
- Kansys provides a summary or a representative copy of the relevant privacy provisions of its contract with that agent to the Federal Trade Commission or other applicable regulatory body upon request.
In the context of an onward transfer, Kansys has responsibility for the processing of personal information it receives under the Data Privacy Framework and subsequently transfers to a third party acting as an agent on its behalf. Kansys shall remain liable under the Principles if its agent processes such personal information in a manner inconsistent with the Principles, unless the organization proves that it is not responsible for the event giving rise to the damage.
Kansys may also be required to disclose, and may disclose, personal information in response to lawful requests by public authorities, including for the purpose of meeting national security or law enforcement requirements.
Data Integrity:
We only process Personal Information in a way that is compatible with and relevant for the purpose for which it was collected or authorized by our clients. To the extent necessary for those purposes, we take measures to ensure that Personal Information is accurate, complete, current and reliable for its
intended use.

Enforcement:
We use a self-assessment approach to assure compliance with this statement and periodically verify that the policy is accurate, comprehensive for the information intended to be covered, prominently displayed, completely implemented and accessible and in conformity with the Principles. In compliance with the Data Privacy Framework Principles, Kansys commits to resolve complaints about our collection or use of your personal information. European Union, Swiss and United Kingdom individuals with inquiries or complaints regarding our Data Privacy Framework policy should first contact Kansys via mail at:

Kansys has further committed to refer unresolved Data Privacy Framework complaints to JAMS, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, please contact or visit https://www.jamsadr.com/dpf-displute-resolution for more information or to file a complaint. The services of JAMS are provided at no cost to you. If neither Kansys nor our dispute resolution provider resolves your complaint, you may have the possibility to engage in binding arbitration through the Data Privacy Framework Panel.
Kansys’ compliance with the DPF is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC).
Policy Updates:
Kansys reserves the right to change this Privacy Policy and notify users of any changes by posting a prominent notice on the privacy section of our website.
